Alcohol Ignition Interlock Device for DWI/DUI Offenders

In New Hampshire, a defendant must install and maintain an alcohol ignition interlock device (“IID”) before license restoration if convicted of certain alcohol-related driving charges. A 12 month period of IID service can cost anywhere from $800-$1400 for just one vehicle.

What is an IID? An IID is a device that requires the driver to breath into it for alcohol analysis each time the engine is started and periodically throughout the drive. If it is found by the court that you often drive a work vehicle or your spouse’s car (or any vehicle you use on a regular basis), those vehicles would be subject to a court ordered IID as well.

How does it work? A breath sensor in the vehicle is attached to a tamper proof control unit on the engine that records the driver’s alcohol concentration with a date and time stamp. The unit will not start if a certain alcohol concentration is detected. In addition, a retest will be required intermittently while the vehicle is in motion to prevent an intoxicated driver from enlisting a friend to provide the first breath to start the car. The units must be inspected per the instructions provided at installation.

A repeat conviction for DUI in New Hampshire, as well as any aggravated DWI conviction, or violation of license suspension as a result of a DUI conviction requires a mandatory period of installation of and compliance with an IID among other severe penalties.  The mandatory minimum period is 12 months. In addition to the mandatory periods of IID installation, the court or DMV may order the installation of the device at its discretion.
